Is this Minettia magna perhaps? Funny pose with its front legs in the air. With that huge humped thorax I first thought of Scathophagidae, but this reminded me of another Lauxaniidae species I see every Spring. I found some on-line Minettia pictures that looked very similar, especially for M. magna. Size was 7.7 mm from the front of the eyes to the rear of the wings. The abdomen was shorter than the wings. I didn't get a dorsal shot, but this view shows the wing a little better than the first picture.
