I think I have this one keyed out to
Neodexiopsis using the Manual of the Nearctic Diptera but, with my luck with muscids, it could be a butterfly.
body ~3.5mm, ~5mm to wingtips
I've found many of these flies just sitting on various flat concrete surfaces in a semi-urban/suburban area – wooded areas, lawns, some ponds and small creeks, etc.
