Scutellum clrearly yellow.
If the Veen's key has all species known... we have just two possibilities:
3.a. Frons with a longitudinal black stripe from antennal implant upwards. 11-12 mm. NL, B, D. -> Conops scutatus Meigen
3.b. Frons with a black cross stripe from one eye to the other. 11-12 mm. Mediterranean. -> Conops silaceus Meigen
It is the second... :) Conops silaceus. :)
I will show why. ;)

more one photo.
This leaves us to an unusual COnops flavipes. Dull thorax on the sides.
What do you think?
