Hallo,
I looked in the Gallery at Drosophilidae, but I did not find such a funny fly. I am shure, most of you will recognize it at once.
I found it in France in the Foret de Palleau north of Chalon sur Saone at 2011-07-15 dancing on the stem of a dead beechtree. The wings were mostly held upwords as in the photo.

Callopistromyia annulipes Macquart, 1855
afaik it was introduced in Europe a few years ago.
