I narrowed it down to Tephritoidea, then started looking at internet photos and came up with Sepsidae.
Hard to photograph, the leaf was waving in the breeze and the little fly was going around and around in a circle. All its circling did let me photograph it from several angles!
Length 3.0, on an herbaceous plant, near a small lake, West Virginia USA, 21 August 2006.

Hi Stephen,
It certainly is a member of the family Sepsidae! Unfortunately I know nothing about the sepsids of the USA, so I can't help you any further (although I would expect this to be a species of the genus
Sepsis).
