Hello! Is this 5-6 mm fly a Heleomyzidae (Tephrochlamys?), too? Also found on Dec-03 in Ostwestfalen/Germany in our garden. Thanks! But then the blueish thorax and the relatively small size let me think of Tephrochlamys.
