black winged prey of E. cf variegata couple

Can someone Id this black winged prey ? I'm not even sure it's a Diptera ... ?

The couple was Identified as Empis cf. variegata in its time.

70 km south of Paris, France, May 15 2010.

I suspect another empid but cannot completely rule out Sciaridae.
