Feeding at Watery Sap

These two flies were feeding on the watery sap on top of a tree stump in early Spring.

Sames species? I think so. The bristle patterns seem the same. One has a pale scutellum while the other doesn't. The wing venation looks different, but maybe that is because the flash illuminated both wings' veins on one picture, but only the top wing veins on the other picture.

They were both the exact same size, 5.2 mm.

Anyhow, I can't seem to figure out which family.

These are drosophilids and I think that they are the same species but that the top one is a teneral.
